Acceptance of Terms

By accessing or using Filament Hub ("the Service") at filament-hub.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. You must be at least 16 years old to use our Service. By using our Service, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into these Terms.

Description of Service

Filament Hub is an educational platform that provides a visual component library showcasing Laravel Filament capabilities, tutorials and guides for building applications with Filament, code examples and implementation guidance, and both free and premium content through various subscription plans. The Service is designed to help developers learn and implement Laravel Filament more effectively through visual examples and comprehensive educational materials.

User Accounts

To access premium features of our Service, you must create an account by providing a valid email address, secure password, and accurate account information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.

You must provide accurate, current, and complete information during registration and keep your account information updated. We reserve the right to suspend or terminate accounts that contain false, inaccurate, or incomplete information.

We may suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, fail to pay required subscription fees, or abuse or misuse the Service in any way that we determine, in our sole discretion, is harmful to the Service or other users.

Subscription Plans and Payments

Our Service offers multiple tiers including a free tier that provides access to basic visual component library features, premium subscriptions available on monthly or annual billing cycles for advanced tutorials and content, and one-time purchases for individual courses or content packages.

All payments are processed securely through Stripe, and subscriptions are billed in advance on a monthly or annual basis depending on your selected plan. We reserve the right to modify our pricing structure at any time, though we will provide at least 30 days' notice of any price changes to existing subscribers. You are responsible for paying any applicable taxes in connection with your use of the Service.

Subscriptions will automatically renew at the end of each billing period unless you cancel your subscription before the renewal date. You can cancel your subscription at any time through your account settings, and cancellation will take effect at the end of your current billing period.

Refund Policy

Customers located in the European Union have the right to cancel their purchase within 14 days of the initial purchase without providing a reason, in accordance with EU consumer protection laws. Refunds for eligible cancellations will be processed within 14 days of receiving your cancellation request.

However, if you have accessed premium content after your purchase, you acknowledge that you are waiving your right of withdrawal for that specific content, as digital content that has been delivered cannot be returned under EU law.

For customers located outside the European Union, we generally do not provide refunds for subscription services or digital content purchases, except as may be required by applicable local law.

To request a refund where eligible, you must email ondrej@filament-hub.com within the applicable time period, include your order number and reason for the refund request, and we will process eligible refunds within 5-10 business days of approval.

Intellectual Property

All content available on Filament Hub, including tutorials, guides, written content, visual designs, layouts, and the Filament Hub branding including logos and trademarks, is the proprietary intellectual property of Filament Hub and is protected by copyright and other intellectual property laws.

Code snippets and examples provided through the Service are made available under the MIT License, which means you may use, modify, and distribute these code examples freely in your own projects. While attribution is appreciated, it is not required for code examples distributed under this license.

Your subscription or account grants you a personal, non-transferable, non-exclusive license to access and use the content for your personal educational and development purposes. You may use code examples in your projects under the MIT License terms, but you do not acquire any right to redistribute, resell, or otherwise distribute our proprietary tutorial content, written materials, or other copyrighted content.

Prohibited Uses

You may not use our Service for any purpose that is unlawful or prohibited by these Terms. Specifically, you agree not to use the Service to violate any applicable laws or regulations, share your account credentials with others or circumvent our access controls, redistribute our copyrighted content without explicit permission, reverse engineer or attempt to extract our proprietary content through automated means, use automated tools such as bots or scrapers to download or extract content from our Service, engage in any fraudulent payment or subscription activities, or impersonate others or provide false information during registration or use of the Service.

Service Availability and Modifications

While we strive to provide continuous and reliable service, we cannot guarantee 100% uptime or uninterrupted access to the Service. The Service may occasionally be unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any interruption of service or inability to access the Service.

We reserve the right to modify, update, or discontinue any aspect of the Service at any time, including features, content, or functionality, though we will provide reasonable notice when possible for significant changes. We may also update content, improve the Service's performance and user experience, and change subscription plans or pricing structures with appropriate notice to existing customers.

Scheduled maintenance will be performed with advance notice when possible, though emergency maintenance may be conducted without prior notice if necessary to protect the security or functionality of the Service.

User Data and Privacy

Your privacy is important to us, and our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your personal information.

Disclaimers and Limitation of Liability

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Our educational content is provided for informational and educational purposes only and may not be suitable for all use cases or development scenarios. Code examples are provided without warranties, and you are solely responsible for testing and validating any code before implementing it in your own projects. We do not guarantee that the information provided will meet your specific requirements or that it will be error-free or uninterrupted.

To the maximum extent permitted by applicable law, our total liability to you for any claims arising out of or relating to these Terms or your use of the Service is limited to the amount you have paid us for the Service in the 12 months preceding the event giving rise to the claim.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, regardless of whether we have been advised of the possibility of such damages.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

Indemnification

You agree to defend, indemnify, and hold harmless Filament Hub and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from your use of the Service, your violation of these Terms, your violation of any third-party rights, or any content you submit or transmit through the Service.

Termination

You may terminate your account at any time by cancelling your subscription through your account settings or by emailing us at ondrej@filament-hub.com. Upon termination by you, your access to premium content will end, though you may continue to access any free content available on the Service.

We may terminate or suspend your access to the Service immediately, without prior notice or liability, if you breach these Terms, engage in prohibited activities, fail to pay required subscription fees, or for any other reason we determine, in our sole discretion, that termination is necessary to protect the Service or other users.

Upon termination of your account, your access to premium content will be immediately revoked, your account data will be deleted within 30 days unless longer retention is required by law, any code examples you have already downloaded will remain available to you under the MIT License, and any payment obligations for services already provided will remain due and payable.

Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Czech Republic and the European Union, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in Prague, Czech Republic.

We encourage you to contact us directly at ondrej@filament-hub.com to resolve any issues or concerns before pursuing formal legal action. If direct resolution is not possible, disputes may be resolved through alternative dispute resolution methods such as online mediation before resorting to litigation.

Nothing in these Terms affects your rights as a consumer under applicable European Union consumer protection laws.

Changes to Terms

We may revise these Terms from time to time to reflect changes in our Service, business practices, or legal requirements. When we make material changes to these Terms, we will notify existing users by email to the address associated with their account and by posting a notice on our website.

Changes will be effective immediately for new users of the Service and 30 days after notification for existing users. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the changes, you should discontinue your use of the Service.
